Ktown Photo Terms of Use

1. Site Operator and Contracting Party

Ktown Photo (photo.ktown.team) is operated by Ktown Team, an independent community organization rooted in Koreatown, Los Angeles, working toward 501(c)(3) nonprofit status. These Terms of Use are between you and Ktown Team only.

During its founding stage, certain technical, infrastructure, and administrative support functions are provided by Ktown Cloud, LLC in support of the platform. Ktown Cloud, LLC is not a party to these Terms, is not the operator of the website, and does not independently offer the website to users.

2. Acceptance

By accessing and using photo.ktown.team, you accept these Terms of Use. If you do not agree, please refrain from using the site.

3. Age Requirement

Ktown Photo is intended for audiences ages 16 and older. By using this site, you confirm that you are at least 16 years old. We do not knowingly collect personal information from individuals under 16 or from children under 13.

4. Access and Viewing

Our website is openly accessible to all, reflecting our commitment to inclusivity and Ktown Team's core value of equity. To ensure fair access, we apply rate limiting and quality adjustment based on system capacity.

5. Image Qualities

Images are provided in multiple quality levels: thumbnail, medium, compact, and original (not publicly served). All publicly served images are watermarked.

6. Acceptable Uses

Images may be used for non-commercial community and educational purposes with proper attribution: "Photo: [Photographer Name] / Ktown Photo (photo.ktown.team)". Embedding is permitted using provided embed codes. Sharing is encouraged with proper credit.

Ktown Team is a non-commercial organization and does not handle commercial licensing. All commercial use inquiries are managed by Ktown Cloud, LLC. Contact [email protected] to be directed to the appropriate contact.

9. Intellectual Property

Images displayed on Ktown Photo are licensed to Ktown Team through Ktown Cloud, LLC. The photographer retains original rights. Ktown Team holds a sublicense to display and distribute images through its community platforms. Ktown Team does not own the underlying copyrights.

All copyright enforcement is handled by Ktown Cloud, LLC as the licensed rights holder. Suspected copyright violations can be reported to [email protected].

10. Privacy and Ethical Standards

All photography follows ethical standards. The collection serves documentary, cultural, and historical purposes. Individuals depicted in images may request removal — see our Copyright Policy for the takedown process. For data handling, see our Privacy Policy.

11. Enforcement

Ktown Team reserves the right, but does not assume an obligation, to review, investigate, or act on suspected violations. Ktown Team may respond to user reports and third-party notices. Ktown Team does not guarantee active monitoring and is not required to take action in every case.

Available actions include: removing or restricting content, disabling embeds, suspending access, requesting cessation of use, preserving evidence, contacting intermediaries, or referring matters to Ktown Cloud, LLC or legal counsel.

Ktown Team's decision not to act in any particular instance does not waive its right to act later.

12. Disclaimer of Warranties and Limitation of Liability

Ktown Photo is provided "as is" and "as available" without warranties of any kind. Ktown Team does not warrant that the site will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by law, Ktown Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site. Nothing in these terms limits liability for fraud, gross negligence, willful misconduct, or any liability that cannot be excluded by law.

13. Changes to These Terms

We may update these terms as needs evolve. Significant changes will be announced with prominent notice. Continued use after the effective date constitutes acceptance.

We aim to resolve disputes in good faith. If a dispute cannot be resolved informally, either party may pursue mediation in Los Angeles County before taking further action.

15. Order of Precedence

In the event of a conflict: (a) the Privacy Policy governs data handling; (b) the Copyright Policy governs image permissions and takedowns; (c) these Terms govern all other matters. If unresolved, these Terms control.

16. General Provisions

Governing Law. These terms are governed by the laws of the State of California. Legal proceedings shall be conducted in the courts of Los Angeles County.

Severability. If any provision is found unenforceable, the remaining provisions continue in full force.

Waiver. Failure to enforce any provision does not constitute a waiver.

Entire Agreement. These Terms, together with the Privacy Policy and Copyright Policy, constitute the entire agreement between you and Ktown Team regarding use of the website.

Notices. All legal notices must be directed to Ktown Team. Delivery to Ktown Cloud, LLC does not constitute notice to Ktown Team unless expressly confirmed.
